Two months after being admitted into a nursing home on August 26, 2004, a woman was found in bed with a spiral fracture of the left tibia and a fracture of the left fibula.

 

The investigation determined that such injuries could not have occurred absent the involvement of another person or persons. The injured woman was hospitalized, and, after treatment, was placed in a cast prior to her admission at a second nursing home. There, a pressure ulcer progressed and became infected, in addition to suffering from dehydration and malnourishment. As a result of alleged nursing home negligence, the resident died on Nov. 17.
A lawsuit was pursued based on alleged nursing home negligence and wrongful death, resulting in an out of court settlement.
