The plaintiff, a farmer, was operating his tractor which was equipped with a power winch designed to be used to pull or drag heavy objects.

 

He was in the process of pulling a car up out of a ditch. He got out of the tractor to hook a cable up. The tractor backed up and caught his leg in the tractor treads, pulling him beneath them. As a consequence he became a paraplegic. The tractor was not equipped with proper safety equipment.[120]
