Ski Boots; Wrong Bindings

Plaintiff, while on a skiing holiday, was traversing a ski slope and attempting to make a turn when he was caused to fall, sustaining a severe fracture to his left leg. Plaintiff's skibindings did not release, which they should have. The ski shop which had sold the ski-bindings and boots to the plaintiff had fitted the boots to the bindings. However, after this occurrence it was learned that the toe piece on the bindings was defectively designed and was not intended to be used with the particular type of boots sold to plaintiff. [57]
